Terms of Service

These Terms of Service (“Terms”) govern your use of the Gardned mobile application and related services (the “Service”), operated by SIA “K13 Group” (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

You may not use the Service for any illegal purpose or in violation of any applicable law or regulation.

3. AI-Generated Content

Gardned uses artificial intelligence to generate planting recommendations, care tasks, and garden planning advice. This content is provided for informational and planning purposes only. We do not guarantee that AI-generated suggestions are accurate, complete, or suitable for your specific conditions. Actual results depend on many factors outside our control, including weather, soil variations, pests, and local microclimates.

4. Acceptable Use

You agree not to:

• Attempt to reverse-engineer, scrape, or extract data from the Service
• Use the Service to transmit harmful, offensive, or unlawful content
• Circumvent any access controls or security measures
• Use automated tools to access the Service except as expressly permitted
• Impersonate any person or entity

5. Your Content

You retain ownership of the garden data, photos, and notes you create in the Service (“Your Content”). By uploading content, you grant us a non-exclusive, worldwide licence to store, process, and display Your Content solely to operate the Service on your behalf.

You are responsible for ensuring you have the rights to any content you upload and that it does not infringe any third-party rights.

6. Subscriptions and Payments

Certain features of the Service may require a paid subscription (“Gardned Pro”). Subscription fees, billing cycles, and cancellation terms will be presented to you before purchase and managed through the Apple App Store or Google Play Store. Refunds are subject to the applicable store's refund policy.

We reserve the right to change subscription pricing with reasonable notice. Continued use of a paid subscription after a price change constitutes acceptance of the new price.

7. Intellectual Property

The Service, including its design, software, and content (excluding Your Content), is owned by SIA “K13 Group” and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED RECOMMENDATIONS WILL PRODUCE ANY PARTICULAR GARDENING OUTCOME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIA “K13 GROUP” SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF CROPS, PLANTS, OR PROPERTY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the Service at any time and delete your account from the app Settings. We reserve the right to suspend or terminate your access if you violate these Terms or for any other reason at our discretion, with or without notice.

11. Governing Law

These Terms are governed by the laws of Latvia. Any disputes shall be resolved in the courts of Riga, Latvia, unless otherwise required by applicable consumer protection law in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
